**Darcy's Garage Doors Terms and Conditions**

 

**1.  Introduction**

Thank you for choosing Darcy's Garage Doors for your garage door needs.  These Terms and Conditions govern your use of our services, including but not limited to the purchase, installation, maintenance, and repair of garage doors and related products.  By using our services, you agree to abide by these Terms and Conditions outlined herein.

We want our customers to fully understand any recommendations that we offer.  Every customer has the right to accept or refuse all or part of our recommendation and/or receive a second opinion.

 

**2.  Definitions**

- "Company", "We", "Our", or "Us" refers to Darcy's Garage Doors.

- "Customer", "You", or "Your" refers to the individual or entity utilizing our services.

- "Services" refers to all services provided by Darcy's Garage Doors, including but not limited to installation, maintenance, repair, and consultation related to garage doors.

- "Products" refers to all products sold or supplied by Darcy's Garage Doors, including garage doors, openers, springs, and accessories.

 

**3.  Scope of Services**

- Our services include the installation, maintenance, and repair of garage doors and related products.

- We provide consultation services to help you choose the right garage door solution for your needs.

- All services are performed by trained and qualified technicians.

- I acknowledge and consent to a mandatory minimum service fee of $100.00 and will be charged by Darcy’s Garage Doors for all service calls to align safety eyes, adjust force and travel settings on operators, and reprogram remotes/keypads.  I also understand that emergency service calls (after hours and Sundays) are subject to a $200.00 service fee, in addition to the cost of repairs and/or replacement parts.

 

- I fully understand the explanation of work received/recommended and assume the responsibility to pay my invoice in full at completion of work.  I also understand that my door will not work properly unless I repair all the problems the technician has recommended.

- It has been explained to me and I understand that my operator may have been strained or worn due to an unbalanced overhead garage door.  The technician has informed me that there is no way to detect the longevity of my operator due to the possible strain.  I understand that there is no guarantee or warranty on a strained/worn operator.  I understand that the door and motor are separate entities and work on one does not guarantee the other will function correctly.

 

**4.  Ordering and Payment**

- Orders for products and services can be placed by phone or in-person.  Missed Service and/or Installation appointments may be subject to the cost of parts in addition to a fee of $100.00.  Rescheduled appointments must be made 24 hours in advance. 

- Darcy’s Garage Doors will send a confirmation text and/or email to the provided contact information on the day preceding the scheduled service appointment. Failure to confirm the service by the customer within the stipulated timeframe will result in automatic cancellation of the service appointment and may result in our company refusing to do business with the customer in the future.

- Payment is due in full upon completion of services, unless otherwise agreed upon in writing.

- We accept various forms of payment, including cash, credit/debit cards, and electronic transfers. A deposit may be required for certain services.  Overdue payments may incur additional fees.

- Darcy’s Garage Doors requires a 50% deposit on all special-order door purchases.  100% of the deposit (50% of the total invoice amount) will be nonrefundable and maybe subject to a 4-to-6-week lead time.

- I understand and agree that Customer shall pay a $35.00 charge for all checks returned from the bank unpaid for any reason.  If such occurs, Darcy’s Garage Doors shall be entitled to demand and be paid in the form of a cashier’s check or money order.  It is understood that in the event of default by the customer, under the terms of this agreement, the customer will be responsible for any and all collection fees or court costs along with reasonable attorney’s fees.  Should litigation or arbitration be required to settle any claim arising from this agreement, the prevailing party in any dispute shall be awarded all their reasonable attorney fees and costs.  Costs shall include, without limitation, expert witness fees, fees paid to investigators, arbitration or court costs.

**5.  Pricing and Estimates**

- Prices for products and services are subject to change without prior notice.

- All estimates provided by Darcy's Garage Doors are valid for a limited period as specified in the written estimate.

- Any accepted estimate that needs to be changed at the customer’s request, must be made within 72 hours of acceptance or may result in additional costs.  

 

**6.  Warranty**

- We offer a warranty on all products and services provided by Darcy's Garage Doors, as specified in the warranty outlined below.

- Warranty claims must be made in accordance with the terms outlined in the warranty documentation.

- I understand that Darcy’s Garage Doors gives a 30-Day labor warranty on every service call from the date of service and after 30 days, if a problem persists, that I will be charged a service fee ($100.00) to come out and assess the situation and that rate is subject to change without notice unless otherwise specified in writing.   

- I understand Darcy’s Garage Doors Warranty is with the Purchasing Customer only and any warranty is not automatically transferable unless stating otherwise in writing.

- I acknowledge that Darcy’s Garage Doors will warranty the motor for one year, as long as a new door and new motor has been purchased and installed through the company directly.  If only a motor has been purchased and installed by Darcy’s Garage Doors, the warranty is valid for 90 days from the date of service.  I understand that Darcy’s Garage Doors will not honor a warrantyon motor installations or replacements if the motor is not purchased through the company directly.

- Darcy’s Garage Doors may facilitate manufacturer warranty issues (when possible) but will charge a service call ($100.00) for this courtesy.  Please see the manufacturer’s manual or website for more information about their warranties.

- Collisions, Acts of God, negligence, intentional damage or failure to maintenance and care for the garage door can result in damage and will not be covered.  To file a warranty claim, call 480-292-5638.

 

**7.  Limitation of Liability**

- Darcy's Garage Doors shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our products or services.

- Our liability for any direct damage shall be limited to the amount paid by the customer for the products or services in question.

 

**8.  Customer Responsibilities**

- Customers are responsible for providing access to the garage and informing us of any existing issues or hazards.  Failure to do so may affect the quality of our services.

- I understand that Darcy’s Garage Doors are not responsible for any future damage to my door that may result from not following the technician’s recommendations.

- I understand that the technician is evaluating the garage door and opener at the time of inspection and a passing grade is no guarantee of the length of time a part will continue to be in proper working order.

- Prior to installation, it is imperative that the garage and its surrounding areas are entirely devoid of any obstructions or debris.  Failure to ensure the complete clearance of the garage may necessitate rescheduling and could result in additional fees.  Additionally, customers are advised to safeguard any finished flooring, as we cannot assume responsibility for any damage incurred during the installation process.  In the event of potential damage, installation may be subject to rescheduling and additional charges may apply.

 

**9.  Intellectual Property**

- All trademarks, logos, and copyrighted materials belong to Darcy's Garage Doors.  Unauthorized use is prohibited.

 

**10.  Privacy Policy**

- We respect your privacy and are committed to protecting your personal information.  Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

 

**11.  Termination**

- We reserve the right to terminate or suspend services to any customer at our discretion.

- Termination of services may occur in the event of non-payment, breach of these Terms and Conditions, or for any other reason deemed appropriate by Darcy's Garage Doors.

- Termination does not relieve any party of obligations incurred prior to termination.

 

**12.  Governing Law**

- These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Arizona.

- Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the State of Arizona.

 

**13.  Amendments**

- Darcy's Garage Doors reserves the right to amend these Terms and Conditions at any time.

- Amendments will be effective immediately upon posting on our website or other notice provided to customers.
